Prosecution Costs successfully opposed

Mr. Makhan Singh Criminal Solicitor-Advocate represented the Defendant P in an Environmental Agency prosecution for causing Pollution of controlled waters by ‘knowingly causing controlled waste to be deposited and in accordance with an Environmental permit’ at Bradford Crown Court on 26th September 2013 and successfully opposed an order for an award of prosecution costs of £155,524.39 to be apportioned between the various defendants. Submissions were made on behalf of P that that costs should only be awarded if they are ‘just and reasonable’ and having regard to the means of the Defendant. The court after hearing mitigation accepted that making such an award would be oppressive and made no award for costs. A charge of ‘Exporting waste without prior notification’ had been withdrawn by the prosecution at an earlier hearing.
