We have a growing expertise in the niche area of defamation and malicious falsehood. This is an increasingly important area of the law given the widespread use of social media, The Defamation Act 2013 has streamlined this area and under the Act, a claimant must now also prove that the defamatory comments caused harm or are likely to cause harm.
Our Mr Bharat Murria was successful recently at the High Court in striking out a defence which purported to rely on the defence of truth. Essentially, when a defence has been struck out in this area, the only issue to be resolved is the level of harm caused and damages. The challenge in these cases is to establish who is involved in producing such videos and who is responsible for its circulation thereafter.
The matter was thereafter settled for a significant sum of damages for the circulation of the video with defamatory material.
