If you are not a British citizen but have children under the aged of 18 that live in the UK, the British Government state that you can apply to live in the UK to care for your child.

However, several requirements apply to individuals hoping to obtain a UK parent visa.

At Murria Solicitors, we appreciate that applying for a UK parent visa can be difficult due to the many requirements and rules in place.  As a result, we have outlined the UK parent visa relationship requirements and discussed what you need to know here.

UK Parent Visa Relationship Requirements Explained

If you wish to apply for a UK parent visa, you must be able to show proof that you have an active involvement in your child’s upbringing. You must also be able to prove that you have a sole or shared responsibility for your child. 

Sadly, failure to meet the UK parent visa relationship requirements may see you ineligible for a visa. 

Relationship Requirements

First and foremost, to apply for a parent visa, as touched on above, your child must be under the age of 18. Your child must also either be a UK or British Citizen.

Due to new Brexit laws, if your child is not a UK or British Citizen, they must have started living in the UK before the 1 January 2021 for you to be considered eligible for a UK parent visa.

Proof Of Involvement In Your Child’s Upbringing

If you are hoping to apply for a UK parent visa, the British Government states that you must be able to prove that you play an active role in your child’s upbringing.  

Although this can be somewhat tricky to prove, the Government will accept letters from your child’s school and healthcare providers.  These letters must confirm that you take your child to school and any medical appointments they are required to attend.

In addition, if your child’s other parent lives in the UK, they can provide written evidence that confirms that you have regular contact with your child.  

Proof Of Parental Responsibility

In addition to the above, to be deemed eligible for a UK parent visa, you must be able to prove that you have parental responsibility for your child.

Typically, this means that you will need to prove that you either have sole responsibility for your child or share parental responsibility.

If you share parental responsibility, your child’s other parent should be a British Citizen or should have settled in the UK. However, the Government states that you must not be in a relationship with your child’s other parent when applying for a UK parent visa.
