Police Victim saved by CCTV

Sep 7 2011

In August 2009, our Client, no stranger to the local Police, was on a night out with his wife in Stafford Town Centre when he was set upon by three unknown males. Police Officers were quick to arrive on the scene and they were quick to presume him guilty. He was arrested on suspicion of common assault while those who attacked him were allowed to walk free. Fortunately the matter was caught on CCTV and it later became apparent that, on this occasion, our Client was in fact the victim. A claim for wrongful arrest and false imprisonment was brought against Staffordshire Police. The Police strenuously denied liability. Our Client was not going to let the matter drop. Court proceedings were issued and shortly after a without prejudice settlement was reached. Staffordshire Police agreed to pay our Client £1100 plus his legal costs. A relatively small award of compensation but nonetheless an important victory for our Client.

The case was handled by our Mr G S Kang, the Head of our Actions against the Police Department, and who acted for the Claimant on a ‘no win, no fee’ basis.
