Claim for Compensation for Wrongful Deportation

Sep 23 2009

A Malaysian Student is suing the Home Office UK Border Agency for wrongful arrest, false imprisonment and unlawful removal from the UK (deportation).

In December 2007 our client was arrested by Officials from the UK Border Agency who alleged that he was an overstayer. Despite his pleas that he was not, the Home Office removed him from the UK and returned him to Malaysia. The Home Office have now admitted that they made a mistake.

A claim for compensation is now being handled by our Mr G S Kang, Partner specialising in claims against the Authorities who said, “Whilst our client should receive substantial compensation for the error, no amount of money can take away the distress and trauma that he suffered knowing that he was being illegally detained and removed from the UK. It beggars belief that such a grave error can be made by the Home Office UK Border Agency bearing in mind the amount of resources it has available.”

At the time of the unlawful arrest, our client did not have any legal representation. He subsequently instructed the Murria Immigration Team who assisted him in obtaining permission to remain in the UK.
