Legal expenses cover - Insurers refuse to pay out - Successful challenge

Murria Solicitors were instructed to act on behalf of an employer in an Employment Tribunal claim brought against them for unfair dismissal. The Employer had legal representation provided for them under the terms and conditions of their business insurance.

The legal representatives for the employer’s insurer advised that they did not believe that the employer had sufficient prospects of success in defending proceedings and subsequently came off the Tribunal record – i.e. stopped representing the employer.

The employer instructed Murria Solicitors to assess the merits, which if positive, to then come onto the Tribunal record. After assessing the merits of the claim, it was apparent that prospects of success were positive and therefore advised both the employer and their insurer of these findings. The insurer, based upon our advice, agreed to fund the legal costs of the proceedings.

The matter proceeded to Trial, and in accordance with our assessment, the claim brought against the employer was dismissed.
