Unlawful Arrest - DNA, Fingerprints and Arrest Details Deleted

On 15 January 2013, our clients, a married couple in their 50s, were at home when Officers from West Midlands Police executed a search warrant at their neighbour’s property. Our clients watched in horror as the Police Officers extended their search into their home and arrested both of them. The couple were taken to Birmingham Central Police Station where they were interviewed. They were released without charge. Our clients, law abiding citizens, were extremely disappointed by the actions of the Officers and were concerned that the arrests may affect their employment because both worked and were subject to enhanced CRB (now called DBS) checks.

On 7 February 2013, we were instructed to pursue a civil action against the Police for, first and foremost, destruction of our clients’ DNA, photographs, arrest details etc. We agreed to act on a ‘no win, no fee’ basis. On 4 October 2013, in an out-of-court settlement, West Midlands Police agreed to destroy our clients’ DNA, photographs, arrest details, etc. and it also paid them £3500 each in compensation.

The matter was handled by our Mr G S Kang, head of the Police Actions Team.
