Reduction of Sentence for Third Strike Burglar

Makhan Singh Solicitor Advocate successfully argued in R v B at Birmingham Crown Court on the 8th October 2013 that the Defendant should not be given the minimum of three years for third domestic burglary under s 111 of the Powers of Criminal Courts (Sentencing) Act 2000. In these ‘third strike burglary cases’ the court can have regard to the particular circumstances of the offence or the offender and that it would be ‘unjust to impose the minimum of three years in all the circumstances. The court accepted submissions that the minimum of three years be reduced by the maximum of 20% due to the indication of a guilty plea early in the proceedings by virtue of Criminal Justice Act 2003, s.144 (2). It should be noted that any burglary committed after the 30th November 1999 even if the Defendant was a youth will qualify as a conviction under the ‘third strike burglary’ cases.
